ICE and the Constitutional Exclusion Zone

Constitutional Exclusion Zone

The “Constitutional Exclusion Zone” (often referred to by the ACLU as the “Constitution-free zone”) is a legal region extending 100 miles inland from all U.S. land and coastal borders. In this area, federal authorities have expanded powers that circumvent standard Fourth Amendment protections against unreasonable searches and seizures.

ICE and the Constitutional Exclusion Zone

Democracy Demands Holding Their Feet to the Fire!

In response to ICE murders in Minneapolis, once again, the twin parties of capitalism, the Republican and the Democratic parties, are playing their usual game – bad cop and good cop. Their goal is to gaslight the people and continue massive police control to limit democracy even further.

Due to the growing national uproar, Trump has removed chief storm trooper, Anthony Bovino, and replaced him with Tom Homan, White House border czar. Homan was videotaped accepting a $50,000 cash bribe from an FBI sting operation. He is also the architect of the notorious immigration policy that separates children from their parents. Homan was first appointed by Obama.

The Democratic leadership supposedly deplores masked killers on the streets, but supports the ICE budget, which has tripled to over $29 billion, making it the largest “police” budget in the world. This week, they call for discussing no more ICE funding separately from the bill to keep the government from shutting down again on Friday. During the first half-year that ICE invaded our cities and murdered Renee Goode, the Democratic Party leadership refused to even discuss limiting the ICE budget.

Behind all the noise, all they ask now is that the latest increases be pulled from the bill that will supposedly extend funding for the government. They do not call for “Abolishing ICE”, but assure us that baby-steps are the only way to go. After the 2020 George Floyd Rebellion, they collaborated to increase the funding of the police.

Politicians have been completely silent about the 100-mile-wide Constitution Suppression Zone for 73 years!

“Under the Immigration and Nationality Act of 1952, border officers have the power, without a warrant, to board and search any vessel in US waters and any railway car, aircraft, conveyance, or vehicle within a reasonable distance from any external US boundary. Congress left the definition of “a reasonable distance” to the executive branch. Federal regulations from 1953 defined it as “within 100 air miles” of any US boundary… this 100-mile-thick border zone is a full perimeter around the country, encompassing 10 whole states, including the entirety of 7 of the 10 most populous US cities. https://pacificlegal.org/wp-content/uploads/2025/12/SR-718-Scacchi-Sweetland-and-Piekoff-Policy-Explainer-The-Fourth-Amendment-Free-Zone-in-the-United-States-v1.pdf

In the Constitutional Suppression Zone, Border control and ICE claim the power to set-up checkpoints, enter and search homes and vehicles without a warrant. This was before Trump weaponized it. Abolishing ICE requires Abolishing the Constitution Suppression Zone!

Across the country, revolutionaries are demanding recognition that the entire status quo is untenable. But the status quo cannot be reformed. It is breaking down before our eyes. Today, we can go beyond “speaking truth to power!!

Trump fascism is seizing political power from cities, states, the courts, and Congress. Democratic and Republican leaders are passively observing the attacks. Corporate dictatorship has emerged as governance by atrocity. This threatens every public institution and requires every single public official to take a stand to Abolish ICE and call out fascism. This is their duty and responsibility as public officials. They cannot permit the weaponization of public safety anywhere!

We have learned to impose resistance and non-cooperation on ICE. We have learned to harass, document, and expose their atrocities. We are learning how to protect our communities and keep everybody safe. In this critical moment, we are learning that political power means forcing the government to do what is necessary to guarantee democracy and the essentials of life for everyone.

Making every public official stand against ICE is one important way the people can exert their political power as the majority and to exert it daily, within and beyond the election cycle.
